Take That, Big Brother!

The Argus Leader reports that a Rapid City lawyer has filed a lawsuit against the Argus Leader Money Cams, er, Traffic Cameras at 10th and Minnesota in Sioux Falls.  Read:

The cameras were a major part of our recent discussion on George Orwell's "1984" held at Augustana College late last month. 

In fact, it was one of the few things fellow attorney and staunch Republican Matt McCaulley and I agreed on at the panel.  While I recognize there was a terrible fatality at that intersection, I think these mindless, unblinking, uncompromising cameras have no discretion and do not take all the facts into consideration.  It turns a traffic violation in a strict liability crime.

I would rather see more police on the streets enforcing our laws and assisting our citizens.  It will be interesting to see how the case turns out.

So, Big Brother, take that!

Um, isn't running a red light a strict liability crime? Either you stop or you don't - it makes no difference if you mean to stop and didn't or have some excuse for not stopping... not stopping is all there has to be for a violation. (Much like speeding - doesn't matter if your speedometer is broken, you go over the limit and you're liable.)

Also - I am not familiar at all with the red-light camera system, but isn't it an administrative (as opposed to criminal) proceeding? Do you have any info on that, Law Reporter Epp?

The problem with cameras is the Chain of Evidence is faulty.

The easiest way to get a case tossed is to dispute the chain-of-evidence, and Not Agree they should be entered into evidence.

Also, these outfits get a portion of the money the ticket generates, so the timing sequence needs to be checked from when lights go from yellow to red.
