Sutton Case in Hurry Up and Wait Mode

As often happens in litigation, there has been a delay—or what lawyers call an extension—in the proceedings.

The Argus Leader has the details:

Court date in Sutton case postponed

PIERRE - With Sen. Dan Sutton’s fate in thehands of the state Supreme Court, both sides agreed to postpone a MoodyCounty court hearing to give the high court more time to rule.But the Supreme Court ruling could come as early as today, somepredict.”They act with extreme dispatch on important cases,” South DakotaAttorney General Larry Long said Wednesday.

These things are not unusual and I don’t think anyone should read anything into it. There are extremely complicated issues of first impression involved, plus Sutton’s seat and his constituents’ representation at stake.

The roller coaster is just paused at the crest of a hill right now.
