Barack Obama, will have at least one vote in the June primary.  I am sending in my absentee/early voting ballot today to the auditor in Canton.  It's good to know that Barack won't be skunked.<br /><br />Speaking of which. <br /><br />How much do you think Barack will win by on June 3d?  Put your predictions in comments.<br /><br />I predict a solid win for Sen. Man Crush--57 to 43 percent.  That might be a little optimistic.  But I expect at least a ten point win.<br /><br />Why?<br /><br />1.  Daschle factor.  South Dakota Democrats like Tom Daschle.  And Tom Hearts Barack.<br />2.  All the other major Democrats back Barack--Sen. Tim Johnson, Rep. Stephanie Herseth Sandlin, Committee People Sharon Stroschein, Chairman Jack Billion, and Sen. George McGovern all have Obamafever.<br />3.  The Obama campaign is running a field campaign for the primary, the likes of which this state hasn't seen.  More staff, more seasoned staff, more volunteers, more money, more resources.  And they've been in place about a month longer than Sen. Hillary Clinton's troops.<br />4.  Sen. Obama has won all of the surrounding states already.  I'd find it hard to believe South Dakota suddenly loves Hillary more.  I'm just sayin'.<br />5.  Sen. Obama needs wins--and big wins--in Montana and South Dakota--the last two primaries--for a post-primary bounce.  It is the final knife in the Clinton campaign and an not too subtle sign to the Superdelegates about who has the best chance of changing the electoral map.<br /><br />But that's why they have elections.  The Clinton campaign has been extremely aggressive as of late in our state. Instances in which analysts appeared on networks other than those with which they were affiliated were not counted. <em>Media Matters</em> counted as appearances both instances in which an analyst appeared as a guest on a show &#8212; either live during the show, or in a pre-taped interview aired during the show &#8212; either live during the show, or in a pre-taped interview aired during the show &#8212; and instances in which a report included a clip of an analyst&#8217;s commentary. The study was limited to appearances made after January 1, 2002. </p><p> Re-airings of news programs in their entirety were excluded from the study. However, instances in which the same report, interview, or quote was aired on different shows or more than once during the course of the same program were counted as separate appearances in this study. If an analyst appeared several separate times during the same show, <em>Media Matters</em> counted each one as a distinct appearance. </p><p> Nexis includes transcripts for all news programs on CNN but for the other cable news networks transcripts are available for only some shows; appearances on programs whose transcripts do not appear in Nexis were not included in this study. </p><p> Finally, the <em>Times</em> article reported that some of the analysts &#8220;pointed out, accurately, that they did not always agree with the administration or each other&#8221; and that &#8220;[m]any analysts strongly denied that they had either been co-opted or had allowed outside business interests to affect their on-air comments, and some have used their platforms to criticize the conduct of the war.&#8221; In conducting this study, <em>Media Matters</em> did not assess whether individual instances of commentary &#8212; or the analysts themselves &#8212; were supportive of administration policy.<br /><br /> </p></blockquote>

I have obtained a copy of the Texas lawsuit (click here for .pdf <img src="http://thunewatch.squarespace.com/layout/iconSets/dark/file.png" class="inline-icon" alt="File" title="File" /><a href="http://thunewatch.squarespace.com/multimedia/4-29-08%20Original%20Petition%20re%20Vranac%20v.%20Legacy%20Inc.%20et%20al.pdf">4-29-08 Original Petition re Vranac v. Legacy, Inc. et al.pdf</a>) as well as a listing of major players in Hyperion from the Texas Secretary of State&#8217;s Office (click here <img title="File" alt="File" class="inline-icon" src="http://thunewatch.squarespace.com/layout/iconSets/dark/file.png" /><a href="http://thunewatch.squarespace.com/multimedia/Hyperion%20Mgt%20team.mht">Hyperion Mgt team.mht</a>).<br /><br />The lawsuit is interesting reading, with some literary flourishes not always found in often dry petitions (complaints).<br /><br />For example:<br /><br /><img src="http://thunewatch.squarespace.com/resource/4.png?fileId=1561523" style="max-width: 800px; width: 567px; height: 171px;" /><br /><br /><em>&#8220;&#8230; Since his marriage to Mary (Huddleston), Albert has pursued a variety of businesses&#8212;always unsuccessfully.  Although he holds the title of chief executive officer of Legacy (the Hunt trust&#8217;s corporation that produces most of its income), his efforts in that position have been unproductive, expensive, and self-aggrandizing&#8230; . &#8220;</em><br /><br /><img src="http://thunewatch.squarespace.com/resource/26%2027.png?fileId=1561518" style="max-width: 800px; width: 579px; height: 550px;" /><br /><br /><em>&#8220;&#8230; Albert (Huddleston) is well-known for his failed business ventures&#8230; . &#8220;</em><br /><br /><img src="http://thunewatch.squarespace.com/resource/35.png?fileId=1561520" style="max-width: 800px; width: 562px; height: 208px;" /><br /><br /><em>&#8220;&#8230; Albert (Huddleston) also requested that a distribution of an additional $20 million be made to Mary (Huddleston) to fund other misquided projects in Iraq and South Dakota. When Plaintiff informed him he was not agreeable to a distribution for these proposed expenditures, Albert became upset and threatened Plaintiff with a lawsuit&#8230; . &#8220;<br /><br /></em>Well, so much for Big Al having the Golden Touch.  This is who Gov. A Month of Light Posting Ahead</title><dc:creator>Todd Epp</dc:creator><pubDate>Mon, 12 May 2008 03:15:59 +0000</pubDate><link>http://thunewatch.squarespace.com/sdwatch/2008/5/12/oh-no-say-it-aint-so-a-month-of-light-posting-ahead.html</link><guid isPermaLink="false">15116:101945:1829674</guid><description><![CDATA[It pains me to do this, but I have some heavy duty work (including preparing for a likely one week-plus federal drug conspiracy trial) ahead of me as an attorney over the next month, plus trying to fit in almost a season's worth of soccer games for my son Matt's team and officiating over the next week and a half, and handling some duties for <a href="http://www.eqsd.org/">EqSD </a>PAC.  <br /><br />Further, the Obama campaign keeps bugging me to help them.<br /><br />And top it all off with the fact that my wife Donna has been on the road almost continuously lately and I'd like to spend some quality time with her.<br /><br />Late June doesn't look much better as I plan to attend the Kansas Bar Convention in Topeka, attend to some additional important EqSD PAC work, and then attend the SD Democratic Convention.<br /><br />Obviously, we're in an exciting time with the South Dakota June Primary Election--the Democratic Presidential Nomination, the Hyperion vote in Union County, and some very interesting Republican and Democratic legislative primaries.  Still, work, family and my hands-on political committments will come first over the coming weeks.<br /><br />Thus, don't expect a lot of blogging over the next month.<br /><br />I'll post as time allows but don't expect anything on a regular basis or much more than a post a day, if that.<br /><br />Sorry, but a blogger's gotta do what a bloggers gotta do.<br /><br />Also after the middle of June, I'm contemplating some minor to major changes in content direction and perhaps even the look.  Stay tuned! The lawsuit alleges the Huddlestons spent the funds on &#8220;a number of misguided business ventures&#8221; and for &#8220;a sizable settlement of a dispute in Vietnam arising from one of Albert&#8217;s personal transgressions involving a female citizen of Vietnam.&#8221;&#8230; </p><p><strong> The suit also alleges that Albert Huddleston asked the trust to award $20 million to his wife for projects in Iraq and South Dakota.</strong> When Vranac said he disagreed, Albert Huddleston became upset and threatened a lawsuit, the filing alleges.</p></blockquote>    Just something else that makes you want to go &#8220;hmmm&#8221; about the project. (I've seen <a href="http://www.siouxcityjournal.com/articles/2008/05/07/news/local/de29165fd70f60e686257441007e456f.txt">no non-Sioux City media</a> with it.)<br /><br />Read: <a href="http://www.siouxcityjournal.com/articles/2008/05/07/news/local/de29165fd70f60e686257441007e456f.txt"><span class="story-headline">County board says signs too big</span></a><br /><br />Excerpt: <br /><br /><blockquote><span id="body"> ELK POINT, S.D. -- The Union County Board of Commissioners will send letters to anti- and pro-refinery groups informing them that campaign signs in the county cannot exceed 25 square feet.</span><br /><span id="body"></span><br /><span id="body">Union County board chairman Doyle Karpen said Union County State's Attorney Jerry Miller told the commissioners during their meeting Monday morning that the county had received a complaint about signs reading "Vote No Hyperion" painted on 4-foot-by-8-foot plywood and displayed outside of Elk Point city limits. He said a county ordinance limits signs in rural areas to 25 square feet.</span><br /><span id="body"></span><br /><span id="body">Miller said the county ordinance specific to election signs does not limit their size, but he believes the general sign ordinance applies to all signs. The law exempts only "on-site" signs, meaning business signs displayed on the business's property, from the size limit...</span><br /><span id="body"></span><br /><span id="body">This strikes me as selective enforcement of the signage ordinance.  First, it appears the election signage ordinance does not cover the size of electioneering signs.*  Second, while I don't know for certain, but 4 x 8 signs are a standard size for campaign signs, particularly in rural areas.  I can't believe prior to the Hyperion election that Rep. Herseth or Sen. Thune or Gov. Rounds didn't have 4 x 8s placed in locations in rural Union County.  I'm sure I've seen such signs on I-29 as I've driven down the Interstate in Union County.</span><br /><span id="body"></span></blockquote><span id="body"><br />Coupled with the bogus "outcry" about Hyperion opponents painting messages on county highways, one wonders if this is further proof of Hyperion's and the County's attempts to stifle dissent against the project by regular citizens.<br /><br />The source who tipped me off to this story and lives in the area certainly thinks that's the case and that the sudden enforcement against Hyperion opponents is suspicious.<br /><br />Hyperion is a apparently a well-heeled company (well-heeled enough to buy land options, open an office, and buy advertising) for their project.  Citizens opposed to the project don't have such resources at their disposal.  Elections and democracy don't work if both sides cannot communicate their message to the voters.  If Hyperion is so confident in a victory for the new zoning ordinances they support, I can't imagine that stifling some 4 x 8 hand painted signs on plywood is going to deter their cause.<br /><br /><i>*Reasonable time, place, manner restrictions on even political expression is Constitutional.  However, the government cannot act in an arbitrary and capricious manner in the enforcement of those ordinances regarding signage.  This is a complicated area of law. John McCain, according to <a href="http://mediamattersaction.org/">Media Matters.</a><br /><br />Here's an email from Media Matters and an excerpt from the book, <i>Free Ride: John McCain and the Media:<br /><br /></i><blockquote>Today, Paul Waldman and <st1:personname w:st="on">David  Brock</st1:personname> are releasing a new chapter to their book, "Free Ride:  John McCain and the Media."  The new chapter is an update to the media coverage  of McCain since the book was published and is available at <span style="color: red;"><a title="blocked::http://www.mccainsfreeride.com/addendum" href="http://www.mccainsfreeride.com/addendum">www.mccainsfreeride.com/addendum</a></span>.<br /><br />Here  is a sample from the new chapter:<br /><blockquote> <p>As <em>Free Ride</em> was nearing its release, we began to hear an  interesting argument from those skeptical of the case we make. Indeed, within  hours, that aspect of the story simply disappeared from public discussion;  instead, McCain and his press team managed to transform the controversy about  him to a controversy about the <em>New York Times</em>.</p></blockquote></blockquote> I had written some time ago about the New York Time's shoddy journalism. There'll be one vote on whether to give the president$162 billion to fund the war through next year—with no strings attached. That's a huge amount to spend on keeping troopsin Iraq, especially at a time when peoples' houses are being foreclosed and unemployment is going up at home.</p><p>Then, there will be separate votes on measures to redeploy our troops and hold the Bush administration accountable for theiractions during the war—measures that could ban torture, hold contractors accountable, and prevent President Bush fromcommitting our troops to a permanent presence in Iraq.<sup>1</sup></p><p>It's important that all members of Congress hear that voters do notwant the president to get another $162 billion blankcheck for the war. George McGovern will announce in Mitchell that he is switching his endorsement from Sen. Hillary Clinton to Sen. Barack Obama.</p><ul><li>Read the Argus story: <a href="http://www.argusleader.com/apps/pbcs.dll/article?AID=/20080507/UPDATES/80507033&referrer=FRONTPAGECAROUSEL" onclick="pausecontent();">McGovern says Clinton should quit race for president</a></li></ul><p>As I predicted, after last night&#8217;s poor showings, we&#8217;ll see considerable Superdelegate and other movement.  The fact that the Clintons both worked for McGovern&#8217;s 1972 Presidential campaign and that he was an earlier supporter of Hillary&#8217;s make this a gut-wrenching loss for the New York Senator.<br /><br />If she does come to Sioux Falls tomorrow, it seems a little awkward to me.</p><p>And one other observation.&nbsp; Even among the most respected and classiest of politicians like Sen. McGovern, they are always seemingly &#8220;politicians.&#8221;&nbsp; The retired ones still jump ship when they see their man or woman losing or in deep do-do.&nbsp; As Pres.
